Whether you are looking to name an executor in your own will or have been named an executor for a will you may have some questions as to just what responsibilities that entails. The executor is given a great deal of responsibility, quite often during a time of great emotional stress. Therefore before naming an executor make sure that the person you pick is capable of carrying out the following duties.

The Duties of an Executor

Once the funeral is over, it is up to the executor to settle the final affairs of the deceased. These include:

  • Settling out any debt that the deceased might have had at the time of their death. This can include things like credit cards, cars and mortgages.
  • Collecting together all of the property of the deceased. This includes belongings and real estate.
  • Identifying and appraising the items that are left behind. This means unless the executor is qualified to do an appraisal they must contract out to a professional who is capable of performing this duty.
  • Filling out all the required paperwork for the inheritance taxes that are to be collected and then paying those taxes before proceeding to probate the will.
  • Filling the proper court documents that show that all heirs agree to the terms of the will.
  • Making sure that the assets are distributed according to the will and the wishes of the deceased.

As you can see, the executor has a lot of duties and responsibilities. If you need help naming an executor or are an executor in need of assistance contact Stano Law group today.
