Dissatisfaction with care and treatment is a common reason for most nursing home disputes. If you have a with a nursing home, the following steps will help in resolving the matter.

  • First, speak to the nursing home staff involved in the dispute. If a resolution cannot be reached, speak to the supervisor. If feasible, ask to arrange a meeting with staff and management to address the matter and come to a solution.
  • Contact the local ombudsperson who is assigned to the nursing home. An ombudsman is an advocate for residents of assisted living facilities, board-and-care homes and nursing homes.
  • If the matter constitutes of violation of patient rights, report it to the state licensing agency.
  • Retain an elder law attorney. The attorney can protect the resident’s rights while ensuring the  nursing home adheres to state-mandated laws and regulations.
  • Hire a geriatric care manager. A geriatric care manager can assess what needs to be done to resolve the matter and and inform the nursing home if any necessary changes that need to be implemented.
  • If necessary, move the resident to another nursing home. You will still have the option to pursue legal action against the previous facility for any harm caused to the your loved one.

Be sure to document, including dates and times, all contact with nursing home staff and any other pertinent parties. Include details about the condition and care of your loved one during their stay.
